The Securities & Business Regulation Division:
    Protecting Georgians From Investment and Charity Fraud


The Division of Securities and Business Regulation administers and enforces the provisions of three Georgia statutes:

  • The Georgia Securities Act of 1973, as amended;
  • The Georgia Cemetery and Funeral Services Act of 2000; and
  • The Georgia Charitable Solicitations Act of 1988.

The Secretary of State is also the Georgia Commissioner of Securities. In that capacity, she regulates the offer for sale and sale of securities within and from the state of Georgia. These securities may range from traditional common stocks and bonds to a broad range of more complex forms of investment contracts, limited partnerships, profit-sharing arrangements and the newly-emerging market in derivatives.

The Secretary of State also registers and regulates perpetual care cemeteries, pre-need dealers, and merchandise dealers in the state. State law does not extend to the regulation of church and municipal cemeteries or family burial plots.

The Secretary of State has regulatory authority over entities which act as charitable organizations in the state and those persons who act as paid solicitors for such organizations.
