Actions Taken by the Georgia State Board of Registration of Used Motor Vehicle Dealers and Parts Dealers, Used Motor Vehicle Division at its March 18 Meeting

Macon, Ga.—The Georgia State Board of Registration of Used Motor Vehicle Dealers and Parts Dealers, Used Motor Vehicle Division met on Wednesday, March 18, 2009.

The Board voted to accept cease and desist orders from each of the following businesses for unlicensed practice:

  • T.C. Sales, Omega
  • Steve Wesley Carusos, Marietta
  • C&V or K&1, Metter
  • Transworld Auto, Atlanta
  • Troy's Paint & Body, Poulan
  • Prime Imports, Thomasville
  • David Hodges Cars & Trucks, Lake Port

The Board issued an Order of Summary Suspension on the following:

  • Atluc, Inc. d/b/a Cars For Credit, Decatur
  • A & J Motorsports Inc., Saint Marys

The Board accepted a Consent Order on the following applicant for probationary licensure:

  • HIMI LLC, Metter

The Board accepted Consent Orders from the following licensees:

  • Shore City Motors, Lithia Springs: Consent order includes a public reprimand and $1,000 fine for tag and title violations.
  • Gil’s Auto Sales, Columbus: Consent order includes a public reprimand and a $500 fine for FTC Buyer Guide violation.
  • Auto’s Unlimited, Carrollton: Consent order includes a public reprimand and a $500 fine for failure to apply for title in retail purchaser’s name within 30 days of the date of sale.
  • Watkins Motor Company, Sandersville: Consent order includes a $1,500 fine for six violations of failure to post FTC Buyer Guides on vehicles offered for sale.
  • Cymill Motors Inc., Decatur: Consent order includes a $1,250 fine for five violations of failure to post FTC Buyer Guides on vehicles offered for sale.
  • Nice Cars, Rome: Consent order includes a $2,000 fine for two tag and title violations.
  • SmartMove Auto, Snellville: Consent order includes a $1,000 fine for tag and title violation.
  • Larry Rich Used Cars, Newnan: Consent order includes probation until March 31, 2010 for operating prior to receiving a license.
  • Smart Cars Etc., Albany: Consent order includes probation until March 31, 2010 for owner’s relationship with another licensee with previous violations.

The Board approved an amended a Final Decision on the following case:

  • Union Auto Sales, Marietta: Amended decision authorizes payment arrangement of previously-assessed fine.

The Board approved Orders Accepting Fine Monies and Settling Inspections on each of the following:

  • Auto Gallery, Lawrenceville: Fined $500 for failure to apply for a title in the retail purchaser’s name within 30 calendar days after the date of sale, and failure to furnish appropriate documents required for tag transfer to the retail purchaser within 30 days of purchase date.
  • Horizon Luxury Cars, Woodstock: Fined $500 for failure to maintain surety bond.
  • Smart Cars, Acworth: Fined $750 for three instances of failure to post FTC Buyer Guides on each vehicle offered for sale.
  • Acceptance Auto Sales, Lithia Springs: Fined $3,500 for 14 instances of failure to post FTC Buyer Guides on each vehicle offered for sale.
  • Acceptance Auto Sales, Douglasville: Fined $3,500 for 14 instances of failure to post FTC Buyer Guides on each vehicle offered for sale.
  • Cars & Trucks Finance Center Inc., Kennesaw: Fined $750 for three instances of failure to post FTC Buyer Guides on each vehicle offered for sale.
  • Winners Circle Motors/Real Easy Payment Options, Winder: Fined $1,500 for six instances of failure to post FTC Buyer Guides on each vehicle offered for sale.
  • Rainey Used Cars Inc., Bronwood: Fined $750 for three instances of failure to post FTC Buyer Guides on each vehicle offered for sale.
  • DR Green Motors, Athens: Fined $1,000 for failure to maintain a surety bond; failure to apply for a title in the retail purchaser’s name within 30 calendar days after the date of sale; and failure to furnish appropriate documents required for tag transfer to the retail purchaser within 30 days of purchase date.
  • Cartersville Automobile Inc., Cartersville: Fined $500 for failure to furnish appropriate documents required for tag transfer to the retail purchaser within 30 days of purchase date.
  • Marietta Auto Mart, Marietta: Fined $1,500 for three instances of failure to apply for a title in the retail purchaser’s name within 30 calendar days after the date of sale.
  • Lovvorn Motors, Douglasville: Fined $500 for failure to maintain surety bond.
  • Gobran Auto Sales, Duluth: Fined $500 for failure to apply for a title in the retail purchaser’s name within 30 calendar days after the date of sale.
  • Finish Line Auto Sales, Sandersville: Fined $2,000 for eight instances of failure to post FTC Buyer Guides on each vehicle offered for sale.
  • Auto Loan Finders, Kennesaw: Fined $1,000 for two instances of failure to furnish appropriate documents required for tag transfer to the retail purchaser within 30 days of purchase date.
  • Taylor's Car Connection Inc., Austell: Fined $1,250 for five instances of failure to post FTC Buyer Guides on each vehicle offered for sale.
  • Guthrie Motors, Douglas: Fined $500 for two instances of failure to post FTC Buyer Guides on each vehicle offered for sale.                                       
  • Image Imports Auto Brokerage Inc., Doraville: Fined $500 for two instances of failure to post FTC Buyer Guides on each vehicle offered for sale.
  • Columbus Auto Mart Inc., Columbus: Fined $1,250 for five instances of failure to post FTC Buyer Guides on each vehicle offered for sale.                                              
  • Eden Auto Brokers Inc., Marietta: Fined $250 for failure to submit application for change of address within 30 days of effective date of change.                                              
  • Gerrald Auto Sales LLC, Savannah: Fined $1,000 for five instances of failure to post FTC Buyer Guides on each vehicle offered for sale and seven violations of failure to apply for a title in the retail purchaser’s name within 30 calendar days after the date of sale.
  • Trademart Auto Sales, Warner Robins: Fined $750 for three instances of failure to post FTC Buyer Guides on each vehicle offered for sale.                                            
  • The Car Lot, Gainesville: Fined $1,000 for four instances of failure to post FTC Buyer Guides on each vehicle offered for sale and four instances of failure to furnish appropriate documents required for tag transfer to the retail purchaser within 30 days of purchase date.

The Board accepted a Voluntary Surrender submitted by:

  • H & N Used Car Dealer, Jonesboro

The Board held a public hearing to consider adoption of posted rule amendments. After the hearing, the Board voted to adopt changes to the following Board rules:

  • 681-3-.01. Complete Applications Forms Required. Policy change allows the Board to update the rule to reflect the current fingerprinting process utilized by the Board and the requirement for photographs of the facility to accompany the application.
  • 681-5-.02. Change of Location. Policy change allows the Board to authorize the charge of a fee for reprinting a license due to a change of location requested by a used motor vehicle dealer.
  • 681-5-.03. Change in Ownership or Registered Agent. Policy change allows the Board to remove the requirement of a new application due to a change in the designee for a used motor vehicle dealership.
  • 681-8-.01. Fees. Policy change allows the Board to provide distinctions and clarification between the renewal periods for used motor vehicle dealers and used motor vehicle parts dealers. The Board mailing address is also updated.
  • 681-9-.02. Responsibilities of a Used Motor Vehicle Dealer. Policy change allows the Board to establish clearly stated responsibilities of used motor vehicle dealers in complying with applicable federal and state laws and rules.
  • 681-11-.02. Criteria for Approval of Seminar. Policy change allows the Board to revise the procedure for reporting seminar attendance and for making a disclaimer by providers of seminars.
  • 681-12-.01. Corporations: Application for Licensure. Policy change allows the Board to establish a form for applying for a new designee for a corporate-owned licensed used motor vehicle dealer and to update the requirement for fingerprinting to reflect the fingerprinting process currently utilized by the Board.
  • 681-12-.02. Partnerships: Application for Licensure. Policy change allows the Board to establish a form for applying for a change in designee for partnerships, and update the fingerprinting process currently utilized by the Board.
  • 681-13-.01. Continuing Education for Renewal. Policy change allows the Board to update the rule to reflect the current process by which licensees notify the Board that the requirement of continuing education for renewal of a license has been met.
  • 681-13-.02. Hour Requirement. Policy change allows the Board to reduce the hour requirement for instruction related to tags and titles from three hours to one hour.
  • 681-13-.03. Division Approval of a Continuing Education Program. Policy change allows the Board to provide for electronic submission of seminar attendees to the Board by seminar providers.
