Why is this necessary now?
A. In order to associate companies with licensees, the Board has deemed it necessary to require all businesses offering Conditioned Air Services in the State of Georgia through individual, licensed Conditioned Air Contractors as agents, officers or partners to complete the Application for Certificate of Authorization to practice. Q. What is the law or rule #? A. Board Rule 121-6-01 and O.C.G.A. 43-14-8 (h) Q. When is the effective date? A. The Effective date for obtaining the Certificate of Authorization is December 31, 2011. Q. When is the deadline date? A. The deadline for submitting the application for Certificate of Authorization is August 31, 2011. Q. Will they receive a copy of the certificate or pocket card? A. No. Q. Will the certificate be a onetime filing or will they be required to renew? A. It will be a one time filing that must be updated if the qualifying licensee leaves the company. Q. If more than one person works for the company, does each licensed person need to register? A. Only the individual in responsible charge of the services performed or offered to performed is required to submit an Application for a Certificate of Authorization, but if the company wishes to list additional licensees in case the qualifier leaves the company they may. Q. If a contractor is employed with a company that doesn’t pull permits, and they only do in-house type jobs, are they required to fill out the form? Example: A condition air contractor that works on units in the hospital? A. No. Only if they qualify a company that contracts conditioned air work. Q. If they work for a private country club or private organization are they still required to apply? A. No. Only if they qualify a company that contracts conditioned air work. Q. What happens if they refuse to submit the form? A. If a company is not registered, the Board may issue a Cease and Desist order. Q. If a licensed conditioned air person is self employed, are they required to register? A. Only if they work under a company name. Q. What if the licensee is the person in responsible charge but they are not a W- 2 employee? A. They must be a W-2 employee unless they are an owner of the company. They cannot be a 1099 sub contractor. Q. Is the contractor qualifying the company required to work full time? A.
