Animal Protection

Citation: Rule 40-13-13-.04(h) Premise Requirements and Performance Standards.
Regulating Agency: Commissioner of Agriculture.
Requirement: To keep complete and accurate records of acquisitions, purchases, sales, releases, natural additions, exchanges, adoptions, custodial care, and health records of all animals.
Persons Affected: All stables, animal shelters, kennels, and pet dealers.
Retention Period: A period of one year.

Citation: Rule 40-13-13-.08(12) Euthanasia.
Regulating Agency: Commissioner of Agriculture and the State Board of Pharmacy.
Requirement: To keep and maintain records signed by the person performing euthanasia and the witness on forms approved by the Georgia Department of Agriculture and the State Board of Pharmacy.
Persons Affected: Animal shelters or other facilities which are operated for the collection and care of stray, neglected, abandoned, or unwanted animals and the supervising veterinarians of such shelters or facilities.

Equine Diseases--The Georgia Equine Act

Requirement: To maintain adequate records of all transactions including the complete name and address of the seller and purchaser.
Persons Affected: Equine auction markets.

Exotic Birds and Pet Birds, Dealers in

Citation: O.C.G.A. Section 4-10-6 Dealer's Duty to Maintain Records;. . ..
Regulating Agency: Commissioner of Agriculture.
Requirement: To keep records sufficient to identify: (1) each exotic or pet bird in a dealer's possession or sold by him, by species and physical description; (2) the name, address, and telephone number of the person from whom each such bird was acquired and, if that person is a licensed bird dealer, his license number or, if that person is not a licensed bird dealer, his driver's license number, social security number, federal tax identification number, or such other identification as may be available; (3) the name, address, and telephone number of the person to whom each such bird is transferred and, if that person is a licensed bird dealer, his license number or, if that person is not a licensed bird dealer, his driver's license number, social security number, federal tax identification number, or such other identification as may be available; and (4) any such bird which the dealer knows to be or have been sick or diseased or to have died.
Persons Affected: Every bird dealer.
Retention Period: At least one year.

Requirement: To keep records which adequately: (1) identify each exotic or pet bird in the dealer's possession or sold by the dealer by species, description, or by leg band number; and (2) verify the name, address, and telephone number of the person from whom each is acquired, and (if that person is a licensed bird dealer) the dealer's license number or (if that person is not a licensed bird dealer) that person's driver's license number, social security number, or federal tax identification number; (3) verify the name, address, and telephone number of the person to whom each bird is transferred, and (if that person is a licensed bird dealer) the dealer's license number or (if that person is not a licensed bird dealer) that person's driver's license number, social security number, or federal tax identification number; and (4) identify any bird which the bird dealer knows to be or to have been sick, diseased, or to have died.
Persons Affected: Bird dealers. [NOTE: Rule 40-13-12-.01 defines "bird dealer" as "any person engaged in the business of dealing in, purchasing, breeding, or offering for sale (whether at wholesale or retail) any exotic or pet birds customarily as pets."]
Retention Period: At least one year from the time of receipt or sale of exotic and pet birds.

Livestock Auctions and Dealers

Citation: O.C.G.A. Section 4-6-46 Maintenance of Records and Accounts; Inspection.
Regulating Agency: Commissioner of Agriculture.
Requirement: To maintain such accounts and records as will at all times disclose the names of the sellers or consignors, the amount due and payable to each from the custodial account for shippers' proceeds, and the legally authorized fees and charges due the establishment.
Persons Affected: Sales establishments for the sale of livestock at auction.

Requirement: To maintain adequate records on sales and purchases, including (but not limited to): (1) the complete name and address of the purchaser and the date of purchase; (2) the complete name and address of the seller and the date of sale; (3) the complete name and address of the herd of origin, if different from the name of the seller; and (4) the identification of the cattle by ear tag, tattoo, breed, sex, and weight.

Poultry

Requirement: To keep records of purchases and sales of poultry products handled in a manner satisfactory to the State Department of Agriculture and the Official State Agency.
