Controlled Substances

Citation: O.C.G.A. Section 16-13-39 Manufacturers, distributors, and dispensers to maintain records of controlled substances.
Regulating Agency: State Board of Pharmacy.
Requirement: To keep a complete and accurate record of all controlled substances on hand, received, manufactured, sold, dispensed, or otherwise disposed of and to maintain such records and inventories in conformance with the record-keeping and inventory requirements of federal law and with any rules issued by the State Board of Pharmacy.
Persons Affected: Persons registered to manufacture, distribute, or dispense controlled substances under the Georgia Controlled Substances Act (O.C.G.A. Title 16, Chapter 13, Article 2).

Citation: O.C.G.A. Section 16-13-94 Maintenance of records of sales to minors.
Regulating Agency: Georgia law enforcement officials.
Requirement: To keep available for inspection by law enforcement officials (1) all written consents of the parents or guardians of persons under 18 years of age to the sale or transfer of possession of model glue to those persons under 18 years of age and (2) the names and addresses of the consenting parents or guardians.
Persons Affected: Persons making a sale or transfer of possession of model glue to a person under 18 years of age.
Retention Period: A period of six months.

Citation: Rule 480-20-.02 Record-Keeping Requirements For Unusual Orders of Controlled Substances by Manufacturers, Wholesalers, and Distributors.
Regulating Agency: State Board of Pharmacy.
Requirement: To maintain records of unusual orders of controlled substances received by the registrant.
Persons Affected: Manufacturers, wholesalers, and distributors of controlled substances who are registered under the Georgia Controlled Substances Act.

Explosive Materials

Citation: O.C.G.A. Section 16-7-90 Any person authorized to manufacture, possess, transport, distribute, or use a destructive device must maintain records pursuant to Title 25.
Regulating Agency: Georgia law enforcement officials.
Requirement: Any person authorized to manufacture, possess, transport, distribute, or use a destructive device, and any person licensed as a blaster is required to maintain such records pursuant to Title 25. Must also promptly report the loss or theft of any destructive device, detonator, explosive, or hoax device to the Georgia Bureau of Investigation.
Persons Affected: Any person authorized to manufacture, possess, transport, distribute, or use a destructive device, and any person licensed as a blaster.

Nonprofit Bingo Games

Citation: Rule 92-2-.23 Location of Records.
Regulating Agency: The Georgia Bureau of Investigation.
Requirement: To maintain: (1) an itemized list of the gross receipts for each session; (2) an itemized list of all expenses other than prizes that are incurred in the conducting of the bingo session as well as the name of each person to whom the expenses are paid and a receipt for all of the expenses; (3) a list of all prizes awarded during the bingo session and the name and address of all persons who are winners of prizes of $50 or more in value and the name of all persons who are winners of prizes less than $50 in value; (4) an itemized list of the recipients other than the licensee of the proceeds of the bingo game, including the name and address of each recipient to whom such funds are distributed; (5) a record of the number of persons who participate in any bingo session conducted by the licensee.
Persons Affected: Nonprofit tax exempt organizations licensed by the Director of the Georgia Bureau of Investigation that conduct or operate bingo sessions.
Retention Period: At least three (3) years from the date on which a bingo session is conducted.
