Claims Advisory Board


The Claims Advisory Board is comprised of the Secretary of State, as chairman, and commissioners from the Department of Human Resources, the Department of Transportation and the Department of Corrections. It is responsible for receiving and reviewing tort claims filed against the state by persons claiming to have incurred personal injury or property damage as a result of negligence by state agencies. The 1963 Act which established the board was amended July 1, 2000 to allow the board to authorize the payment of claims involving alleged negligence when the amount of the claim is $5,000 or less. For claims exceeding $5,000, the board is responsible for determining the relative merit of the claim and for making an advisory recommendation to the General Assembly. For a claim to be decided by the General Assembly, a resolution must be introduced in the House of Representatives and then approved by both the House and the Senate.
